Terms of Service

These terms govern your use of RevPARGenius Hotel AI Visibility. They include how subscriptions and payment work, what you may and may not do, and the limits of what the service guarantees.
These Terms of Service ("Terms") govern your access to and use of RevPARGenius Hotel AI Visibility (the "Service"), operated by RevPARGenius, a sole proprietorship registered in the Philippines ("RevPARGenius", "we", "us"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
Hotel AI Visibility is a subscription software product that tracks how AI assistants (such as ChatGPT, Perplexity, Gemini and Grok) name, rank and describe your hotel in response to traveler questions, and reports visibility, position, sentiment, cited sources and recommendations.
2. Accounts and Eligibility
You must be at least 18 years old and able to form a binding contract. You may register with an email and password or via Google sign-in. You are responsible for the accuracy of your information, for keeping your credentials secure, and for all activity under your account. Notify us immediately of any unauthorised use.
3. Subscriptions and Payment
Paid plans (Independent, Growth, Portfolio, Agency) are billed in advance on a recurring basis (monthly or annual, as selected) and renew automatically until cancelled. Prices are stated on our pricing page in USD and may change with notice for future billing periods.
Once enabled, payments are processed by our Merchant of Record, Paddle.com, which handles billing, applicable taxes (VAT/GST/sales tax) and payment-related support. RevPARGenius does not collect or store your payment card details. By subscribing, you authorise recurring charges to your chosen payment method until you cancel.
4. Plan Limits and Fair Use
Each plan includes defined limits (number of properties, tracked prompts, refresh frequency and manual "run" actions per day). These limits exist to manage the real costs of querying third-party AI providers. We may apply rate limits and a global daily ceiling to protect the Service, and may contact you about usage that materially exceeds your plan.
5. Acceptable Use
You agree not to: resell or redistribute the Service or its data outputs without our written consent; reverse engineer or scrape the platform; attempt to bypass plan or rate limits; or use the Service unlawfully or to harm its security or operation.
6. Third-Party AI Providers
The Service generates results by sending queries to third-party AI providers and processing their responses. We are not responsible for the content, availability, or accuracy of those providers' outputs, and your use is also subject to their terms.
7. Data Accuracy — Decision Support Only
AI assistants produce variable, non-deterministic answers, so visibility data is sampled and reported as trends over time. The Service is a decision-support tool provided "as is"; we do not guarantee the accuracy, completeness or timeliness of any metric, and it should not be your sole basis for commercial decisions. You remain responsible for your own decisions.
8. Intellectual Property
The Service, including its software, design and reports, is owned by RevPARGenius and its licensors. We grant you a limited, non-exclusive, non-transferable right to use it for your internal business purposes during your subscription. The data and inputs you provide remain yours.
9. Limitation of Liability
To the maximum extent permitted by law, RevPARGenius is not liable for indirect, incidental, special or consequential damages, or loss of profits or revenue. Our total aggregate liability for any claim shall not exceed the amount you paid us in the three (3) months before the event giving rise to the claim.
10. Termination
You may cancel at any time (see the Refund & Cancellation Policy). We may suspend or terminate access for breach of these Terms or conduct that harms the Service. Sections on intellectual property, disclaimers, liability and indemnification survive termination.
11. Changes
We may update these Terms from time to time. The current version will always be on this page, and continued use after changes take effect constitutes acceptance.
12. Governing Law
These Terms are governed by the laws of the Republic of the Philippines, with exclusive jurisdiction in the courts of the Philippines.
